Terms and conditions of sale and use

This translation is provided for convenience. In case of discrepancy, the French version prevails.
1. Purpose
These terms govern subscriptions to the Link. by Le Toucan service, which lets you create a personalised link page at link.letoucan.mc/your-name, with a QR code and statistics. Signing up means you accept these terms.
2. Provider

3. Plans and prices

Prices are in euros, all taxes included. Monthly plans: the first month of each new subscription is free. Yearly plans: the price equals 10 months, i.e. 2 months free.
4. Account
Signing up requires a valid e-mail address and a password, which you agree to keep confidential. You are responsible for the use of your account.
5. Payment
Payment is made through PayPal (PayPal account or bank card).
- Monthly: nothing is charged when you sign up. The first payment is taken one month later, then every month on the same date.
- Yearly: the yearly amount is charged when you sign up, then every year on the same date. We send you a reminder e-mail at least 15 days before each renewal.
If a payment fails, the subscription may be suspended and the page taken offline.
6. Duration and cancellation
Subscriptions have no commitment beyond the current period. You can cancel at any time from your account (“My subscription”). Cancelling during the free month means you pay nothing. Otherwise, cancellation takes effect at the end of the period already paid (month or year); the current period is not refunded pro rata.
You can change plans at any time from your account.
7. Right of withdrawal
If you are a consumer, you have 14 days from signing up to withdraw, without giving any reason, by writing to [email protected]. By signing up, you ask for the service to start immediately.
- Monthly: as the first month is free, nothing is owed during this period.
- Yearly: the amount paid is refunded within 14 days, minus the value of any NFC card(s) already supplied (€14.90 per card).
7 bis. Free NFC card
The yearly Pro and Business plans include 1 and 2 NFC cards respectively, programmed with your page address. They are prepared by Le Toucan, then handed over in our shop (4 avenue des Castelans, Monaco) or sent by post, normally within 15 days. The card belongs to you. It opens your page as long as your subscription is active; when the subscription ends, it leads to an unavailable page. One card offer per yearly subscription taken out; extra or replacement cards are charged.
8. Your page and its content
You are solely responsible for the content of your page. You agree to publish only lawful content for which you hold the rights (including logos and trademarks), and not to link to fraudulent, illegal, hateful or pornographic websites. Le Toucan may suspend or delete, without notice, any page that breaks these rules.
9. Page address and QR code
Your page address and its QR code remain active as long as your subscription runs. The QR code stays valid even if you change your links. When the subscription ends, the page goes offline and the QR code leads to an unavailable page. The address is kept for 12 months in case you subscribe again.
10. Availability and liability
Le Toucan does its best to keep the service available 24/7 but cannot guarantee it (maintenance, host or network outages). Its liability is limited to the amount paid by the customer over the last 12 months and does not cover indirect damage (loss of revenue, reputation, etc.).

12. Changes to terms and prices
Any change to prices or terms will be notified to you by e-mail at least 30 days before it applies. You may then cancel free of charge before it comes into force.
13. Governing law and disputes
These terms are governed by Monegasque law. If there is a problem, please contact us first at [email protected] to find an amicable solution. Failing that, the courts of Monaco have jurisdiction, subject to any more protective rules that consumers enjoy in their country of residence.
